PREFACE

As of November 1996, the Columbus City Codes had been being supplemented by Matthew Bender & Company, Inc., its successor in interest to Book Publishing Company.

Beginning with Supplement 25, Municipal Code Corporation will be keeping this code current by regular supplementation.

This supplement brings the Code up to date through Ordinance 0838-2019 passed March 18, 2019.

ORDINANCE NO. 1-59

To approve, adopt and enact "The Columbus City Codes, 1959"; to repeal certain ordinances in conflict therewith or deemed obsolete; and to declare an emergency.

 WHEREAS, this Council authorized a general compilation, revision and codification of the ordinances of the City of Columbus, Ohio, of a general and permanent nature; and,

 WHEREAS, such compilation, revision and codification has now been completed to the satisfaction of this Council; and,

 WHEREAS, an emergency exists in the usual daily operation of the various departments and divisions of this government in that it is immediately necessary to effectuate, the aforesaid compilation, revision and codification to avoid practical and legal entanglements; now, therefore,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

Section 1. That the ordinances of the City of Columbus, Ohio, of a general and permanent nature, as compiled, revised, rearranged, renumbered and codified in Exhibit A (attached hereto and made a part hereof), are hereby ordained as general ordinances and are hereby approved, adopted and enacted as "The Columbus City Codes, 1959."

Section 2. That all provisions of said Codes shall be in full force and effect on and after 12:01 A.M., February 1, 1959, and all ordinances or parts of ordinances in force on January 1, 1959, which are inconsistent with any provision of "The Columbus City Codes, 1959" are hereby repealed from and after 12:01 A.M., February 1, 1959, except as hereinafter specifically provided.

Section 3. That the repeal provided for in the preceding section of this ordinance shall not affect:

(a)

any offense or act committed or done, or any penalty or forfeiture incurred, or any contract or right established or accruing before the first day of February, 1959;

(b)

any ordinance or resolution promising or guaranteeing the payment of money by or to the City, or authorizing the issuance of any bonds of the City, or any evidence of the City's indebtedness, or any contract or obligation assumed by the City;

(c)

the administrative ordinances or resolutions of the Council not in conflict or inconsistent with the provisions of these Codes;

(d)

any right, license, privilege or franchise conferred by any ordinance or resolution of the Council on any person or corporation;

(e)

any ordinance establishing, naming, relocating or vacating any street or public way;

(f)

any ordinance levying or imposing taxes, assessments or charges;

(g)

any ordinance providing for positions, vacations, sick leave, or compensation;

(h)

any ordinance establishing or changing the boundaries of the City, or establishing ward boundaries for the City;

(i)

any prosecution, suit or other proceeding pending, or any judgment rendered on or prior to the thirty-first day of January, 1959;

(j)

any ordinance which may be adopted by Council after the first day of January, 1959.

Section 4. That all of the provisions of this ordinance, including 'The Columbus City Codes, 1959", hereby adopted, shall become effective at, on and after 12:01 A.M. Eastern Standard Time, February 1, 1959.
