The director may order any person who causes or contributes to violations of this
chapter to show cause why a proposed enforcement action should not be taken. The person
shall be served notice of the hearing, specifying the place and time of the hearing,
the proposed enforcement action and the reasons for such action, and a request that
the person show cause why this proposed enforcement action should not be taken. The
notice of the hearing shall be served personally at least ten (10) days prior to the
hearing. Such notice may be served on the principal executive, general partner, or
corporate officer, or authorized agent or representative of the entity. The person
listed as the company contact in a permit issued pursuant to this chapter may be considered
an authorized agent for purposes of this section. Any person ordered by the director
to appear at a show cause hearing who fails to appear shall be deemed to have agreed
to whatever action is taken by the director as the result of the hearing. Actions
taken by the director resulting from a show cause hearing are not subject to the appeal
provisions set forth in Section 1145.94 of this chapter.
