§ 1147.09. Right to hearing and appeal.

  • Wastewater strength characteristics shall be determined by personnel of the division of sewerage and drainage on the basis of best available data including information from monitoring programs, analytical data, and other valid sources of information on characteristics of specific wastewater discharge. Each extra strength user shall be notified in writing of the appropriate standard industrial classification categorization and wastewater strength determination prior to being designated extra strength. Such notification shall also inform the extra strength user of the opportunity to review the designated standard industrial classification category or strength classification with the division of sewerage and drainage. Any classification may be subject to a hearing with the director of public utilities in the event the validity of the standard industrial classification categorization and/or strength determination is questioned. The director's decision shall be subject to request for reconsideration by the wastewater review commission in accordance with procedures specified in Section 1145.21 of the Columbus City Code, 1959.
