§ 1927.05. Compensation; physical examinations.

  • In all cases of accident or injury in line of duty of members of the division of fire where a major operation, a major procedure or treatment requiring hospitalization, for which the Industrial Commission of Ohio allows medical compensation under the workmen's compensation laws, is necessary, and the police and fire surgeons are equipped to perform such service, and he is requested by such member, or the members of his family in case he is unable to make such request, to perform such service, then in that event such police or fire surgeon may make a charge and receive pay therefor from the Industrial Commission of Ohio; provided, however, that nothing in this section shall be construed to prevent police and fire surgeons from being employed by and performing medical or surgical service for a member of the division of fire for sickness incurred or injuries sustained not in line of duty, and make a charge and receive pay therefor; provided further, that police and fire surgeons may charge a fee of two dollars ($2.00) for each physical examination made in connection with examinations held by the Civil Service Commission of the City for applicants for Fire Department service. One dollar ($1.00) of such examination fee shall be remitted by the police and fire surgeon to the Civil Service Commission and one dollar ($1.00) of such fee shall be retained by the police and fire surgeon making the physical examination as his compensation for conducting such examination; provided further, that the Civil Service Commission shall appoint any physician they choose to make these examinations.
