§ 2131.13. Starting and backing vehicles.

  • (a)

    No person shall start a vehicle that is stopped, standing, or parked until such movement can be made with reasonable safety and so as to yield the right-of-way to moving vehicles.

    Before backing, operators of vehicles shall not move unless such movement can be made with reasonable safety and without interfering with other traffic and shall give ample warning, and while backing they shall exercise vigilance not to injure persons or property on the street or highway.

    (b)

    No person shall back a motor vehicle on a freeway, except: in a rest area, in the performance of public works or official duties, as a result of an emergency caused by an accident, or as a result of a breakdown of a motor vehicle.

    (c)

    No operator of a vehicle shall back such vehicle from any alley, private driveway, or building across the centerline of any street of sufficient width to allow two (2) or more moving lanes of traffic in each direction.

    (d)

    Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one (1) year of the offense, the offender previously has been convicted of or pleaded guilty to one (1) predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one (1) year of the offense, the offender previously has been convicted of two (2) or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
