§ 3118.08. Hearing on appeal.

  • On appeal the board of commission appeals shall consider the contents of the case file and sworn testimony before the board. No new evidence or claim shall be heard. The applicant, any aggrieved third party, and a representative from the commission may attend the hearing and give testimony under oath. If substantial new information which would have had a bearing on the commission's decision had it been available to the commission becomes available between the time of the commission's final order and the board's appeal hearing, the case shall be remanded to the commission for rehearing.
