§ 3511.04. Approval.

  • After the public hearing, the city council may approve the renewal plan. In the event that city council approves the renewal plan, it shall include in its approval the following findings:

    (a)

    That the area described in the development plan is a slum, blighted, deteriorated or deteriorating area.

    (b)

    That there is a feasible method for the temporary relocation of the families displaced from the project area and that there are or are being provided in the project area or in other areas not less desirable in regard to public utilities and public commercial facilities at rents and prices within the financial means of the families displaced by the project area, decent, safe and sanitary dwellings equal in number of and available to such displaced families, and reasonably accessible to their places of employment.

    (c)

    That financial aid to be provided by the federal government, if any, is necessary to enable the land in the project area to be renewed in accordance with the renewal plan.

    (d)

    That the renewal plan with the project area will afford maximum opportunity consistent with the sound needs of the locality as a whole for the renewal of the project area by private enterprise.

    (e)

    That the renewal plan is feasible and conforms to the general plan and the workable program for slum elimination and prevention.

    The standards and controls embodied in the plan so adopted and approved shall thereafter become enforceable in the same manner as ordinances of the city.
