§ 563.01. License required.

  • Any person who shall exhibit or participate in exhibiting, in the city, any circus, menagerie, carnival, or free show, whether under canvas tent or otherwise, shall before giving such performance secure a license from the license section. If there are one or more buildings used for residence purposes within a distance of two hundred feet in any direction from the lot or parcel of ground on which such circus, menagerie, carnival or free show is to be given and performed such application for a license shall be accompanied by the written consent signed by the majority of the tenants or owners, as the case may be, occupying such buildings. A license fee of fifty dollars ($50.00) per night shall be charged, for each and every night such circus, menagerie, carnival or free show is exhibited or performed.

    Any person who shall exhibit or participate in exhibiting, in the city, any circus, menagerie, carnival or show, whether under canvas, tent or otherwise, in which any horses or other animals are exhibited, or in which the performance or use of such horses or other animals forms a part of the show, shall, before giving such performance, secure a license from the license section. If such show is to continue for more than one calendar day and if there are one or more buildings used for residence purposes within a distance of two hundred feet in any direction from the lot or parcel of ground upon which such show is to be given and performed, such application for a license shall be accompanied by the written consent signed by a majority of the tenants or owners, as the case may be, occupying such buildings.
