§ 2327.13. Rabies immunization.

  • (A)

    No person shall own, keep, harbor or have charge of any dog, cat, or immunizable animal over three (3) months of age unless such dog, cat, or immunizable animal shall have been immunized against rabies as required by the regulations of the health department.

    (B)

    Failure to display a current rabies immunization tag on a dog shall be prima facie evidence of lack of immunization.

    (C)

    The failure to immunize will subject the dog, cat or immunizable animal to impoundment.

    (D)

    Whoever violates this section is guilty of failing to immunize, a minor misdemeanor. If the dog, cat or immunizable animal previously has been determined to be a nuisance, dangerous or vicious animal then a violation of this section is a misdemeanor of the second degree.

    (E)

    Strict liability is intended to be imposed for a violation of this section.
